Understanding an Italian lease: terms and questions for Americans
An Italian lease can look unfamiliar even when you read the language. This guide explains the terms you are likely to see and the questions to ask the landlord or a professional before you sign. It does not tell you what is legal or standard, because that depends on the contract and the city.
Before you read the contract
Ask for the full contract in advance, not at the signing. Read it with someone you trust who reads Italian, or with a professional if the stakes justify it. If you are not sure about something, ask in writing and keep the answer.
Terms you will meet
Contratto di locazione: the lease.
Locatore / conduttore: landlord / tenant.
Canone: the rent. Ask how often it is paid and how.
Deposito cauzionale: the security deposit. Ask when and how it is returned.
Spese condominiali: shared building costs. Ask which are included in the rent and which are billed separately.
Durata: the length of the contract. Ask what happens at the end.
Disdetta and preavviso: ending the contract and the notice you must give. Ask how to do it formally.
Registrazione: registering the contract with the tax authority. Ask who does it and how you receive proof.
Inventario: the list of furniture and appliances. Ask for a written, dated one.
Reading it step by step
Check that names, addresses and the property description are correct.
Find the sections on payment, deposit, shared costs, length and ending the contract.
Mark anything you do not understand and write your question beside it.
Ask whether the contract will be registered, by whom, and how you will receive the registration details.
Ask about utilities: in whose name they are and who pays what.
Photograph the property and meters at handover, and attach the photos to the inventory.
Keep the signed contract and all receipts in one place.
Why registration matters to you
Many other offices ask for a registered lease as proof of address, for example when you register your residenza or apply for a permesso di soggiorno. Ask early how and when you will get the registration paperwork.
Common mistakes
Paying cash without a receipt. Ask for a written receipt for any payment.
Signing before reading the shared-cost clause.
Skipping the handover photos.
Assuming every term is standard. Ask about anything that surprises you.
Questions to ask the landlord
Can I have the contract in advance to read?
Which shared costs are included in the rent?
How is the deposit held and returned?
Who registers the contract, and how will I receive proof?
How do I end the contract, and what notice do you need?
Can you confirm in writing that I can use the contract for my residence registration?
